Taking notice of the growing discontent of those who have suffered at the hands of globalization through job loss, stagnant wages, and economic insecurity, the editors of World Trade and Investment Law Reimagined: A Progressive Agenda for an Inclusive Globalization invited twenty-one experts from ten different countries to present heterodox perspectives from economics and law to reconsider the political economy of global trade and investment. The contributions take the form of short, diverse, and engaging essays. While they explore diverse issues (each deserving of assiduous discussion), the essays share four elements. First, the authors recognize the maldistributive effects of the extant trade and investment regime, and the resulting legitimacy crisis. Second, they reject the view that enhancing economic efficiency, or increasing aggregate welfare, suffices to justify this regime. Third, they question the idea that wealth redistribution should remain exclusively a national question. Finally, the authors share the premise that the global economy is created by the legal system.

Les dispositions qui visent à la réduction des obstacles non tarifaires et notamment des divergences réglementaires constituent la principale innovation du CETA et celle qui présente les gains économiques potentiels les plus importants. Pour promouvoir la compatibilité et la convergence de leurs réglementations, l'Union européenne et le Canada ont ainsi établi des mécanismes de coopération qui pour la première fois intègrent l'application d'instruments et de pratiques de bonne politique réglementaire au sein d'un traité commercial et créent un cadre institutionnel permanent, destiné à encadrer et promouvoir cette coopération. Bien qu'ils ne modifient pas directement les procédures législatives et réglementaires de l'UE et de ses Etats membres et sont présentés comme volontaires, ces mécanismes de coopération réglementaire figurant dans les accords commerciaux dits de nouvelle génération, tels que le CETA, inquiètent la société civile européenne. Celle-ci craint notamment que ces mécanismes ne portent atteinte aux principes démocratiques et notamment à l'autonomie réglementaire des Etats parties et à leur faculté de protéger, voire de rendre plus contraignantes, les normes de sécurité, de santé, sociales ou environnementales. La présente prend au sérieux ces craintes et tend à y répondre par une analyse descriptive puis évaluative des dispositions du CETA sur la coopération réglementaire. L'analyse procède par ailleurs d'une application du cadre analytique développé par le Max Planck Institute for Comparative Public and International Law dans le cadre de l'établissement de la théorie du droit public international.

The provisions aiming at reducing non-tariff barriers and notably regulatory differences are the main innovation in CETA and the one that presents most important economic gains. In order to promote compatibility and convergence of their regulations, the EU and Canada have established cooperation mechanisms that, for the first time, integrate guidelines regarding good regulatory policies within a trade agreement but also set up permanent institutional schemes with the objective of facilitating and promoting regulatory cooperation between the parties. Even though these regulatory cooperation mechanisms included in the new generation of trade agreements such as CETA, do not modify directly the legislative and regulatory procedures of the EU and its Members states and are presented as voluntary for the parties, the European civil society is very much concerned about them. It fears that these mechanisms will endanger European democratic principles and restrict the regulatory autonomy of the parties and notably their right to adopt rules in order to follow socio-environmental objectives. This article aims at taking these worries seriously and putting forward an analysis of the regulatory cooperation provisions within CETA which is firstly descriptive and then evaluative. This analysis follows the framework established by the Max Planck Institute for Comparative Public and International Law in the context of the development of an international public law theory.
